ChromaWings Digital Color Palettes - Terms & Conditions

1. Acceptance of Terms

By purchasing and downloading our digital color palettes, you agree to abide by these Terms & Conditions. Please read them carefully before using our products.

2. Licensing and Usage Rights

2.1. Usage Scope: Our digital color palettes are licensed for use by individual color analysts, image consultants, or similar professionals ("Users") in their professional services. These palettes are intended solely for enhancing your color analysis consultancy.

2.2. Prohibited Actions: Users are prohibited from:

  • Selling or reselling the palettes as standalone products.
  • Distributing the palettes to third parties outside of their consultancy services.
  • Modifying, reverse engineering, or decompiling the palettes.
  • Using the palettes in any way that infringes upon intellectual property rights.

2.3. Commercial Use: Users may not use the palettes for commercial purposes unrelated to their professional services without prior written consent from ChromaWings.

3. Money Back Guarantee

3.1. Guarantee Period: ChromaWings offers a 30-day money back guarantee. If you are unsatisfied with our product, you may request a refund within 30 days of your purchase date.

3.2. Refund Criteria: To be eligible for a refund, you must provide a valid reason, such as:

  • The colors in the palettes do not match the specified seasons.
  • You did not receive the complete package as described in the product description.

3.3. Refund Process: To request a refund, please contact us at hello@chromawings.com. Our team will review your request, and if it meets the criteria, a refund will be processed within 5 business days.

4. Product Ownership

4.1. Intellectual Property: ChromaWings retains all intellectual property rights to the digital color palettes. Users are granted a non-exclusive license for use as defined in Section 2.

4.2. Transfer of Ownership: Users may not transfer or assign their license to another party without prior written consent from ChromaWings.

5. Limitation of Liability

5.1. No Warranty: ChromaWings provides the digital color palettes "as is," without any warranty, express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose.

5.2. Limitation of Liability: In no event shall ChromaWings be liable for any direct, indirect, incidental, special, or consequential damages arising out of the use or inability to use our products.

 

6. Termination

6.1. Termination of License: ChromaWings reserves the right to terminate a User's license for any breach of these Terms & Conditions.

7. Governing Law

7.1. Jurisdiction: These Terms & Conditions shall be governed by and construed in accordance with the laws of European Union.

These Terms & Conditions constitute the entire agreement between ChromaWings and the User, supersedes any previous agreements, and may only be modified in writing and agreed upon by both parties.
